GENERAL TERMS AND CONDITIONS OF SALE


Article 1 — Identification of the seller

Hereinafter referred to as "Merka" or "the Seller".


Article 2 — Purpose and acceptance

These General Terms and Conditions of Sale (GTCS) govern the contractual relationship between Merka and any natural or legal person (hereinafter "the Member" or "the User") taking out a subscription to the merka.world editorial platform.

Registration and subscription to Merka imply full and unconditional acceptance of these GTCS. The Member declares having read them and accepted them before any subscription.


Article 3 — Description of the service

Merka is a curated editorial platform. It offers its Members access to a collection of editorial profiles on selected brands, places, objects and personalities, chosen by the Editor-in-Chief, as well as thematic dossiers and a weekly newsletter.

The service includes in particular:

— Access to all profiles published on merka.world

— Access to thematic dossiers

— Delivery of the weekly newsletter

— Access to new items published each week

Merka reserves the right to evolve the content and features of the service at any time.


Article 4 — Prices and subscription plans

Merka offers two subscription plans:

— Premium Monthly: €5 incl. VAT per month, renewed monthly

— Premium Annual: €50 incl. VAT per year, renewed annually (equivalent to €4.17/month)

Prices are shown in euros, all taxes included. Merka reserves the right to change its prices at any time. Any change will be notified to Members by email at least 30 days before it takes effect. Changes apply only to subscriptions taken out thereafter or to upcoming renewals.


Article 5 — Payment terms

Payment is made online by bank card via Stripe, a secure PCI-DSS Level 1 certified provider. Merka stores no bank data of its Members; this data is processed exclusively by Stripe.

The subscription is activated immediately after payment confirmation.

In the event of payment failure (card declined, expired, etc.), Stripe will make several charge attempts over 7 days. If all attempts fail, the subscription will be automatically suspended and access to Premium content disabled.


Article 6 — Automatic renewal

The Premium subscription renews automatically at the end of each period (monthly or annual), by tacit renewal, until cancelled by the Member.

For annual subscriptions over €30, in accordance with Article L.215-1 of the French Consumer Code, Merka will remind the Member by email, at least 30 days before renewal, of their option not to renew the subscription.


Article 7 — Termination and cancellation

The Member may cancel their subscription at any time from the "My account" area of the platform, free of charge and without justification.

Cancellation takes effect at the end of the current subscription period:

— For a monthly subscription: at the end of the current month

— For an annual subscription: at the end of the current year

The Member retains access to the Premium service until that date, after which access will be disabled.

No refund, in whole or in part, will be made for the subscription period already paid for.


Article 8 — Right of withdrawal

In accordance with Article L.221-28 of the French Consumer Code, the Member expressly acknowledges that:

— The Merka service is digital content not supplied on a tangible medium

— Performance of the service begins as soon as payment is confirmed, with immediate access to Premium content

— By subscribing, the Member expressly requests immediate performance of the service and expressly waives the 14-day right of withdrawal

This waiver is evidenced by the validation of the order after acceptance of these GTCS.


Article 9 — Intellectual property

9.1 — Merka content

All editorial texts (titles, descriptions, thematic dossiers, newsletter) published on merka.world are the exclusive property of Pauline Gayat and Merka. Any reproduction, distribution, modification or use, in whole or in part, without prior written authorization is strictly prohibited and constitutes infringement punishable under Articles L.335-2 and following of the Intellectual Property Code.

9.2 — Visuals from third-party brands

Merka is a curated editorial platform. The visuals presented are taken from the public Instagram accounts of the brands, places and personalities mentioned, and remain the exclusive property of their authors. Merka claims no rights to these visuals, systematically cites the source and invites readers to follow the official accounts.

9.3 — Use by the Member

The subscription grants the Member a personal, non-exclusive and non-transferable right of access to Merka's Premium content. The Member undertakes not to reproduce, copy, sell, resell or exploit, in whole or in part, any of Merka's content for commercial purposes.


Article 10 — Member account

The Member undertakes to provide accurate information when registering. They alone are responsible for the confidentiality of their login credentials. Any use of the account is deemed to be made by the Member themselves.

Merka reserves the right to suspend or delete any account in the event of non-compliance with these GTCS, in particular in the event of abusive sharing of login credentials or any attempt to bypass the paywall.


Article 11 — Liability

Merka undertakes to provide a quality service accessible 24/7. However, interruptions may occur for reasons of maintenance, updates or force majeure. These interruptions do not give rise to compensation or refund.

Merka cannot be held responsible for:

— Indirect damages resulting from use of the service

— Temporary unavailability of the site

— Content from the third-party brands cited


Article 12 — Personal data

The personal data collected (email, last name, first name, payment data) are processed in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act.

In accordance with these regulations, the Member has the right to access, rectification, erasure, data portability and objection to the processing of their personal data. To exercise these rights, simply write to pauline@merka.world.

Data are kept for the duration of the subscription and up to 3 years after the end of the contractual relationship for legal and accounting reasons.

The following processors handle the Member's data:

— Stripe (payment)

— Memberstack (account management)

— Framer (hosting)

— Substack (newsletter, optional)


Article 13 — Changes to the GTCS

Merka reserves the right to modify these GTCS at any time. Any material change will be notified to Members by email at least 30 days before it takes effect. Members may then cancel their subscription free of charge if they do not accept the new terms.


Article 14 — Governing law and jurisdiction

These GTCS are governed by French law. In the event of a dispute, and after an attempt at amicable resolution, the French courts shall have exclusive jurisdiction.

For any dispute, the Member may also make free use of the following consumer mediator: [insert mediator if you have one, otherwise delete this line].
